<초록 / Abstract>
평화협정이란 분쟁 당사자 간 무력분쟁을 종결하고 화해와 공존을 제도화하며 관련된 모든 당사자들이 평화를 보장하게 하도록 하는 법적·정치적 성격을 지닌 포괄적인 합의문으로 정의할 수 있다. 평화협정이 체결되었다고 하더라도 반드시 평화가 보장되는 것은 아니다. 단순히 어느 하나의 평화협정을 통해 분쟁 상태가 종료된다기보다는 분쟁 해결의 과정 속에서 여러 협정이 체결되기 때문이다. 평화협정에 대해 분쟁을 종결하고 평화의 상태로 가는 과정적 관점으로 이해할 필요가 있다. 따라서 평화를 구축하는 과정에서 체결되는 평화협정들은 각각의 상황과 국면에 따라 그 속성이 다르게 나타날 수 있다. 이에 본 논문은 이스라엘-팔레스타인 간에 체결된 평화협정을 예비적 기초협정, 실질적 기본협정, 보완적 이행협정 등으로 유형 구분을 시도하였다. 이스라엘과 팔레스타인 간에는 반세기 이상 지속되어온 분쟁해결을 위해 여러 차례의 평화협정이 체결되었음에도 불구하고 여전히 분쟁이 지속되고 있다. 분쟁을 해결하기 위해 체결되는 평화협정에 대해 유형화한다면 분쟁의 양상과 평화협정의 본질에 대해 보다 명확히 파악할 수 있을 것으로 판단된다. 평화협정이 분쟁 당사자 간의 관계개선이나 협력을 넘어 제도화된 갈등을 관리하는 장기적인 전략의 연속적 형태로 갈등전환적 접근을 위한 실천적이고 이행적인 역할로 파악해야 할 것이다.
A peace agreement is an extensive document of a legal and political nature, drafted to assure peace between two or more states. The agreement not only brings conflict to an end, but also institutionalizes reconciliation and coexistence. Nonetheless, the peace agreement itself does not necessarily guarantee peace. It is not a single agreement that terminates disputes, but a series of agreements that are brought into force during the process of resolution. Hence, one needs to understand peace agreement as a process — beginning with the termination of conflict and culminating in a state of peace. Peace treaties signed in the process of peacebuilding may be categorized into three different types in accordance with the situation which they are concluded in. In this article, I categorize peace agreements between Israel and Palestine into the following three types: the preliminary basic agreement, the actual fundamental agreement, and the complementary practiced agreement. Categorizing peace agreements in this way would clarify and enhance our understanding about their nature. Peace agreements should be approached as management mechanisms for institutionalized conflicts that take on a strategic and consecutive form in order to allow transition.
